Terms & Conditions

Please read the following terms and conditions. They limit our liability and that of the air carriers providing your trip arrangements. In addition, they outline the conditions under which your trip will operate. Acceptance of final tour documents represents an acceptance by the purchaser of the terms and conditions as follows.

HOW TO BOOK
Contact your professional travel agent.

Reservations: Should be made well in advance as some lodges are limited in size, and sell out well in advance due to seasons.  To assure your first choice of accommodation, an early reservation is essential.

Deposit: A deposit equal to 20% of your total trip cost is required to book your space. If departure date is within 65 days, full payment will be required in lieu of deposit.

Final Payment: Final payment is due 65 days prior to departure.

CANCELLATIONS CONDITIONS AND CHARGES
a) 20% of total trip cost is forfeited for cancellations made 66 days or more prior to departure.*
b) 50% of total trip cost is forfeited for cancellations made between 65 and 30 days prior to departure.*
c) 100% of total trip cost is forfeited for cancellations made 29 days or less prior to departure. *Plus applicable third party charges.

In some instances, lost and/or unused airline tickets are not refundable or replaceable.
We strongly recommend “trip cancellation” insurance.

Included in tour price:

Accommodations: As specified in the itinerary, or similar, will be provided in hotels, lodges camps based on two persons sharing a room with private bath or shower. The right is reserved to substitute hotels, camps, and lodges when necessary. Service charges and taxes are included for all accommodations.

Single Accommodations: Are at an additional cost as indicated in the programs. For those who travel alone and desire to share a room, African Travel, Inc., will endeavor to accommodate the travelers as desired. However, if a single room must be utilized due to unavailability of a roommate, or the roommate’s cancellation, the single room supplement will be charged. Please note our tours are based on a minimum of two passengers.

Meals: are provided as specified in each program.
(B)=Full American Breakfast, (L)=Table d’hote lunch, (D)=Table d’hote dinner.

Transfers: between airports, rail stations, motorcoach terminals and hotels are provided, when specified, throughout with two pieces of luggage per person.

Sightseeing: as specified in each itinerary in the most modern and comfortable transportation equipment available with English speaking drivers/guides.

Airline Baggage Allowance: Airline Baggage Allowance guidelines and limits with regard to number of pieces, linear measurements and weight vary according to domestic U.S., international and internal African carriers. Please check with the air carriers in your itinerary as the allowances can change. On small chartered flights within Africa, strict luggage restrictions apply; details are provided in the tour documents.

Baggage: On Wing Safari, you will be permitted one soft-sided bag, which should weigh between 25 and 44 lbs., depending on type of aircraft and destination. Your tour documents will advise the appropriate weight limit. Excess baggage should be stored at passenger’s expense. Luggage and personal effects are at the owner’s risk throughout the travel program.

Tour Planning: Tour planning, preparation, marketing and operational costs ARE included in the tour price. These prices are based on tariffs, taxes and rates of exchange in effect at the time of printing. African Travel reserves the right to increase tour prices due to fluctuations in tariffs, taxes or foreign rates of exchange.

Revisions To Itinerary: A fee of $100 will be charged for a revision to a confirmed itinerary.

Late Booking Fee: A fee for additional communications and expedited mail costs will be charged when applicable.

Not included in tour price:
LAND ONLY prices do not include airfares, costs of obtaining passports, visas, inoculations, excess baggage charges, all items of a personal nature such as drinks, laundry, telephone calls and cables, meals not specified in the itinerary, personal and baggage insurance, local airport taxes and tips to waiters, hotel staff, game rangers and sightseeing drivers and guides.

Gratuities: Tips to tour guides, waiters, hotel staff, baggage handling and game rangers are not included and are at the tour participant’s discretion.

Air Travel Taxes: Taxes and fees imposed by governments and other authorities are NOT included in the air fares quoted and may include SEPT 11TH SECURITY FEE of $2.50 per passenger per flight segment (maximum $5 oneway / $10 roundtrip), PASSENGER FACILITIY FEE (PFC’s) of up to $16 per passenger, FEDERAL DOMESTIC FLIGHT SEGMENT FEE of up to $3.30 per passenger per flight segment, US or INTERNATIONAL DEPARTURE AND ARRIVAL CHARGES of up to $200 may apply, depending on the itinerary. Taxes are subject to change until the time of purchase.

Refunds: will not be made for occasional missed meals or services, or for any absence from the tour of less than 4 consecutive days, or for hotel accommodations not utilized. Applications for refunds must be made in writing to African Travel, Inc., within 30 days of tour termination.

Visa/Inoculations: Visa and immunization requirements vary from country to country and up-to-date information should be obtained from your local health department and consulate. Visas are required for most areas in the tour programs and this information may be obtained from your local consulates.

Important Note: Tour arrangements are intended for persons of reasonably good health and without physical disabilities which would create a hazard either for the passenger or other passengers. By forwarding deposit for passage, the passenger certifies that he or she does not have any physical disability that might create a hazard for themselves or other tour participants. African Travel, Inc., reserves the right to decline to accept or retain any person as a tour participant should such person’s health or mental condition impede the operation of the tour.

Responsibility: African Travel, Inc., Glendale, California, your travel agent, outfitters, operators of the tours and/or subcontractors of services act only as agents for the supplier in regards to travel, whether by plane, car, motorcoach, ship or railroad and assume no liability for injury, damage, loss, accident, delay or irregularity, which may be occasioned either by reason or defect of any vehicle, act of war, insurrection, revolt or other civil uprising, other military action, strikes or any Act of God occurring in either the country of origin, destination or through passage, or for any reason whatsoever, or through the acts or default of any company or persons engaged in arrangements of the tour. They cannot accept any responsibility for losses or additional expenses due to delay or changes in schedules or other causes. All such losses or expenses will be the responsibility of the member of the tour, as the rates provided are for the arrangements only at the time stated. The right is reserved to make any adjustments to the itinerary and the right is reserved to cancel any tour prior to departure. African Travel, Inc., may not be held responsible for any loss or damage to luggage, before, during or after the tour program. The acceptance of final vouchers or tickets shall be deemed to be consent to the above conditions.

Airline Responsibility Clause: The airlines concerned are not to be held responsible for any act, omission or event during the time the passengers are not aboard their conveyance. The passenger contract in use by the airlines concerned when issued, shall constitute the sole contract between the airline and the purchaser of the ticket. Prices are based on tariffs in effect as of August 1, 2010, inclusive of fuel surcharges and other airline charges and are subject to change without notice until the time of purchase.

DISCLOSURE NOTICE

Please be aware that during your participation in an African Travel, Inc. safari tour, certain risks and dangers may arise including, but not limited to, the hazards of traveling in undeveloped areas, travel by boat, train, automobile, aircraft or other means of conveyance, the forces of nature, political unrest and accident or illness in remote regions without means of rapid evacuation or medical facilities. Also be aware and clearly understand that African Travel, Inc. will not have liability regarding provision of medical care or the adequacy of any care that may be rendered.

You are voluntarily participating in these activities with the knowledge of the dangers involved and hereby agree to accept any risks.

AS LAWFUL CONSIDERATION for the agreement with African Travel, Inc. to participate in such trips and activities you hereby agree that you will not make a claim against African Travel, Inc., or sue for bodily injury, emotional trauma, death and/or property damage, however caused, as a result of your participation in the safari tour. You therefore release African Travel, Inc. and its employees from any and all claims, known or unknown, arising from your participation in a tour.
This release of Liability and Assumption of Risk agreement is entered into on behalf of all members of your family including minors accompanying you. This agreement is binding on your heirs, legal representatives and assigns. If any portion of this agreement is unenforceable, the remaining portions shall remain in full force and effect.

Any litigation involving this contract, any of our brochures or your trip can be brought only in courts of competent jurisdiction in the county of Los Angeles, state of California and California law will be applicable to any disputes, which arise out of your trip.

Passengers who purchase from within California: This transaction is covered by the California Travel Consumer Restitution Fund (TCRF) if the passenger is located in California at the time of payment. Eligible passengers may file a claim with TCRF if the passenger is owed a refund of more than $50 for transportation or travel services which the seller of travel failed to forward to a proper provider or such money was not refunded to you when required. The maximum amount which may be paid by the TCRF to any one passenger is the total amount paid on behalf of the passenger to the seller of travel, not to exceed $15,000. A claim must be submitted to the TCRF within 12 months after the scheduled completion date of the travel. A claim must include sufficient documentation to prove your claim and a $35 processing fee. Claimants must agree to waive their right to other civil remedies against a registered participating seller of travel for matters arising out of a sale for which you file a TCRF claim. Passengers purchasing from outside of California: This transaction is not covered by the California Travel Consumer Restitution Fund.

This business is a participant in United States Tour Operator’s Association’s (USTOA) Consumer Protection Deposit Plan. You may make a claim to this Plan if you are owed a refund. The Plan covers losses for transportation or travel services that were not delivered or not refunded when required. A passenger may make a claim against the plan within 12 months from when the passenger learns of the loss. USTOA’s total liability for all possible consumer claims from this seller of travel’s customers is limited to $1,000,000. To obtain information on how to make a claim against the plan, the passenger should contact USTOA at 275 Madison Ave., Suite 2014, New York, NY 10016, or by email to information@USTOA.com or by visiting their web site at www.USTOA.com. The maximum amount of any claim you, the passenger, can make against the plan is the total amount you have paid to date for this trip. The traveling public has always been concerned about the protection of their advanced bookings. As part of African Travel, Inc.‘s commitment to providing our customers with peace of mind, we have provided First Horizons Merchant Services (our credit card processor) with a letter of credit in excess of $20 million to underwrite all credit card transactions made by Visa or MasterCard that are placed directly with African Travel Inc. This is another of the many commitments we have made to ensure that our customers travel experience is more secure.
